These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of HongKong.

These Terms of Service ("Terms") govern the purchase and use of products ("Products") and services ("Services") offered by AriaEar. By placing an order or engaging with our Services, you agree to be bound by these Terms. Please read them carefully before proceeding with your purchase.


1. Intellectual Property and Resale Policy

  • Ownership: All intellectual property rights related to the Products, including but not limited to designs, technical documentation, software, website content, and branding materials, are the exclusive property of AriaEar or its licensors. These are protected under applicable copyright, patent, trademark, and other intellectual property laws.

  • Usage Restrictions: Products purchased from AriaEar are intended solely for personal, end-user use. Resale, distribution, or commercial use of Products without prior written authorization from AriaEar is strictly prohibited.

  • License: Customers are granted a limited, non-exclusive, non-transferable license to use the Products for personal purposes only. Any unauthorized reproduction, modification, or distribution of AriaEar’s intellectual property is prohibited and may result in legal action.


2. Orders

  • Order Acceptance: All orders placed through AriaEar’s website or other authorized channels are subject to acceptance by AriaEar. We reserve the right to refuse, cancel, or modify any order at our discretion, including but not limited to cases involving:

    • Errors in product descriptions, pricing, or availability.

    • Suspected fraudulent activity or unauthorized use.

    • Limited stock or supply chain constraints.

  • Order Confirmation: Upon order placement, you will receive a confirmation email with order details. This confirmation does not guarantee acceptance; we will notify you separately if an order is accepted or rejected.

  • Cancellation by AriaEar: If an order is canceled by AriaEar, you will be notified via email, and any payments made will be refunded to the original payment method within 5–7 business days, subject to payment processor timelines.

  • Customer Cancellation: Requests to cancel an order must be submitted to info@ariaear.com before production begins or, for custom orders, before ear impressions are received. Cancellations may be subject to a restocking or processing fee, depending on the order status.


3. Pricing and Payment

  • Pricing: All prices listed on the AriaEar website are in [Insert Currency, e.g., USD] and are subject to change without prior notice. Prices displayed at the time of order placement will apply to that order.

  • Taxes and Fees: Customers are responsible for all applicable taxes, duties, and additional fees (e.g., customs or import fees for international orders) associated with their purchase.

  • Payment Methods: We accept the following payment methods: PayPal, VISA, MasterCard, American Express, Discover, and Affirm (where available). All payments must be made in full at the time of purchase unless otherwise agreed (e.g., through Affirm’s installment plans).

  • Payment Security: AriaEar uses secure payment processing systems to protect your financial information. We are not responsible for delays or issues caused by third-party payment processors.

  • Currency and Errors: In the event of a pricing error on the website, AriaEar reserves the right to correct the error and either cancel the order or offer you the option to proceed at the corrected price.


4. Build and Finish Quality

  • Quality Assurance: All Products undergo rigorous testing and inspection prior to shipment to ensure they meet AriaEar’s sound quality standards.

  • Handcrafted Nature: Due to the artisanal and handcrafted nature of our Products, minor cosmetic variations may occur, including but not limited to:

    • Microbubbles or small imperfections in finish.

    • Slight color or texture differences compared to digital renderings or previews.

    • Minor deviations in fit or appearance for custom-molded Products.

  • Customer Acknowledgment: By purchasing, you acknowledge that such variations are inherent to handcrafted Products and do not constitute defects unless they significantly impact functionality.

  • Defective Products: If a Product is found to be defective due to manufacturing issues, please refer to our Return and Refund Policy for instructions on initiating a return or replacement.


5. Order Modifications

  • Modification Requests: To request changes to your order, contact our customer service team at info@ariaear.com as soon as possible after placing the order.

  • Limitations:

    • Pre-Production: Modifications to standard orders may be permitted before production begins, subject to availability and approval.

    • Custom Orders: For custom-molded Products, modifications to design, fit, or other specifications cannot be made once ear impressions are received or production has started.

    • Fees: Changes to orders may incur additional fees, which will be communicated prior to processing the modification.

  • Non-Modifiable Orders: Orders in production or shipped cannot be modified. In such cases, you may need to initiate a return or place a new order, subject to our Return and Refund Policy.

6. Shipping and Delivery

  • Shipping Policy: AriaEar will ship Products to the address provided during checkout. Customers are responsible for ensuring the accuracy of shipping information.

  • Delivery Timelines: Estimated delivery times are provided at checkout but are not guaranteed. Delays may occur due to carrier issues, customs processing (for international orders), or unforeseen circumstances.

  • Risk of Loss: Risk of loss or damage transfers to the customer upon delivery to the shipping carrier, except where prohibited by law.

  • International Shipping: Customers are responsible for all customs duties, taxes, and clearance fees for international orders. AriaEar is not liable for delays or seizures by customs authorities.

7. Limitation of Liability

  • General: To the fullest extent permitted by law, AriaEar shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our Products or Services, including but not limited to loss of data, profits, or use.

  • Product Use: Customers are responsible for using Products in accordance with provided instructions and guidelines. AriaEar is not liable for damage or injury resulting from improper use or modification of Products.

  • Warranty: Products are covered by a limited warranty, as detailed in the product documentation or on our website. This warranty does not cover damage due to misuse, neglect, or unauthorized repairs.

8. Amendments to Terms

AriaEar reserves the right to modify or update these Terms at any time without prior notice. The most current version will be posted on our Term of Service. Continued use of our Services or placement of orders after changes constitutes acceptance of the updated Terms.
